Ferrari does own him, to a degree. Many players in professional sports have clauses in their contracts which specify that they're not allowed to do dangerous things outside of their time with the team. Chicago Bulls player Jayson Williams is a prime example. His contract forbid him riding motorcycles, but he did anyway - and crashed, ruining his leg and most likely ending his career. The Bulls have been nice and paid him up to this point, but they will not pay the rest of his contract.

We don't know what MS' contreact says, unfortunately.
